Terms and Conditions

These Terms and Conditions govern your use of the BT Sportswear NZ website and the purchase of custom uniform services. By placing an order, you agree to these terms in full.

1. Custom Orders & Cancellations

All custom orders are made to order and non-refundable once production has commenced. Cancellations must be requested within 24 hours of ordering. An administration fee may apply to approved pre-production cancellations.

2. Turnaround Times

Turnaround times are estimates only and begin once the design proof has been approved and the deposit received. Our standard timeframes are:

Sublimated Garments: 4–6 weeks
High Quality Cut & Sew Garments: 8–10 weeks

Delays due to supplier issues, design approval, or circumstances beyond our control do not constitute grounds for cancellation or refund. We recommend ordering well ahead of your required date.

3. Returns & Exchanges

We do not accept returns or exchanges on custom items unless the product is faulty or does not match the approved design proof. Faults must be reported within 7 days of receipt. Our obligations are consistent with the New Zealand Consumer Guarantees Act 1993.

4. BTSPORTSWEARNZ Logo on Custom Uniforms

The BTSPORTSWEARNZ logo is strategically positioned on all custom uniforms to denote our manufacturing partnership and certify that the apparel adheres to professional performance benchmarks. The primary justifications for its placement are:

Brand Authority: As a leading New Zealand-owned apparel provider, the logo signifies the use of high-performance textiles and professional manufacturing protocols, confirming that teams are equipped with professional-grade gear engineered for performance and durability.
Official Partnership Visibility: Within professional leagues and sports organisations, manufacturer logo placement is standard practice, identifying BTSPORTSWEARNZ as the official apparel partner.
Marketing & Promotion: Uniforms serve as mobile promotional platforms — the logo enhances brand recognition and identifies BTSPORTSWEARNZ as the designer and provider of the team's custom apparel.
Identity & Authenticity: The logo differentiates authentic BTSPORTSWEARNZ products and ensures uniformity across all teamwear, supporter apparel, and merchandise lines.
Approval & Usage: Unauthorised reproduction, duplication, or sale of BTSPORTSWEARNZ garments or designs is strictly prohibited under the New Zealand Copyright Act 1994. All designs remain the intellectual property of BTSPORTSWEARNZ and may not be copied, replicated, or resold without prior written consent.

Clients may request logo removal for an additional fee. Requests must be made in writing before production commences. BTSPORTSWEARNZ reserves the right to decline removal requests at its discretion.

5. Design Approval

A digital proof will be provided for approval before production. Clients are responsible for checking all details. We are not liable for errors approved at the proof stage.

6. Pricing & Payment

All prices are in NZD and inclusive of GST unless stated otherwise. A 50% deposit is required before production commences, with the remaining balance due prior to dispatch. BTSPORTSWEARNZ reserves the right to adjust pricing without notice for future orders.

7. Intellectual Property

Designs and branding created by BTSPORTSWEARNZ remain our intellectual property unless agreed otherwise in writing. By submitting client artwork, you warrant you have the right to use it.

8. Limitation of Liability

To the extent permitted by law, our liability is limited to the value of goods supplied. We are not liable for indirect or consequential loss.

9. Indemnification

By placing an order, you agree to indemnify and hold harmless BTSPORTSWEARNZ, its directors, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms and Conditions, your use of our products, or any infringement of third-party rights resulting from artwork or instructions you have provided.

10. Termination

BTSPORTSWEARNZ reserves the right to terminate any order or client relationship where these terms have been breached, fraudulent activity has occurred, or conduct is deemed harmful to our business. Deposits may be forfeited to cover costs incurred, and no refund will be issued once production has commenced.

11. Severability

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and will not affect the validity or enforceability of the remaining provisions.

12. Waiver

No failure or delay by BTSPORTSWEARNZ in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy. A waiver of any breach shall not be deemed a waiver of any subsequent breach of the same or any other provision.

13. Entire Agreement

These Terms and Conditions, together with any order confirmation, design proof approval, and written correspondence, constitute the entire agreement between you and BTSPORTSWEARNZ in relation to your order. They supersede all prior discussions, representations, or agreements, whether written or verbal.

14. Governing Law

These terms are governed by the laws of New Zealand. Disputes are subject to the exclusive jurisdiction of New Zealand courts.
